Terms of Service

These terms cover two things: using this website, and hiring Junk Magik LLC to haul for you. Booking a job or using this site means you accept them. If something here doesn’t sit right, call us before you book rather than after.

What we do

We remove and haul junk — furniture, appliances, garage and home cleanouts, estate clearouts, yard and construction debris, office and commercial work. We cover the Bay Area, and availability depends on the day, the crew, and how far out you are. Ask if you are not sure we reach you. Sending a request doesn’t book a job; a job is booked once we’ve confirmed it with you.

Estimates and price

We price by the space the load takes in the truck, not by the hour. An estimate given from photos or a description is exactly that — an estimate based on what we could see. The final price comes once we’ve looked at the actual load, and you get that number before we start.

If what’s there turns out to be more than what you described, or the job needs work you didn’t mention — a long carry, stairs, dismantling, items that need special handling — we’ll tell you what the price is now and you decide whether to go ahead. We don’t change a price after the fact.

Payment

Payment is due when the job is done, unless we’ve agreed something else with you in writing beforehand. Commercial and recurring work can be arranged differently — ask.

Booking, access and cancellations

Tell us as early as you can if you need to move or cancel a booking. A booked slot is a truck and a crew not somewhere else.

We need to be able to reach the items. That means someone authorized present or the access arranged, gates and doors open, and somewhere legal to park the truck. If we arrive and we can’t get to the load, can’t park, or nobody can point at what’s going, we may have to reschedule.

What we can’t take

Some things we’re not permitted to carry, and no crew will take them regardless of what was discussed when booking:

  • Paint, solvents, motor oil and fuel
  • Propane tanks and pressurised cylinders
  • Asbestos, and anything suspected of containing it
  • Medical, biohazard and sharps waste
  • Ammunition, fireworks and explosives
  • Loose or leaking chemicals of any kind

If any of this turns up in a load, we’ll leave it and point you to somewhere that handles it. Not sure whether something counts? Ask before the day — it’s a two-minute phone call and it saves a wasted trip.

Appliances, hot tubs and anything connected

Anything wired, plumbed or gassed in needs disconnecting before we arrive, by you or by a licensed trade — we don’t disconnect electrical, gas or water lines. Appliances containing refrigerant are handled separately and need to be declared when you book.

What’s going, and what isn’t

This is the important one. Once something is on the truck, treat it as gone. Before we start, please:

  • Go through it for anything valuable, sentimental, or with personal information on it — paperwork, drives, photos, keys, cash in furniture.
  • Clearly separate or mark anything that is staying. If it’s in the pile, we’ll assume it’s going.
  • Make sure you actually own the items, or have permission from whoever does, to have them removed.

By booking, you confirm you have the right to have the items removed, and you accept responsibility if it turns out you didn’t. We can’t recover items once they’ve been processed at a facility, donated, or recycled.

Where your load goes

We sort loads and route what we can to reuse and recycling rather than landfill. What’s possible depends on the item, its condition, and what our partners and facilities accept that week, so we don’t promise a specific destination for any specific item. Documented disposal or destruction for commercial work can be arranged — tell us before the job, not after.

Your property

We’re licensed and insured, and we work carefully in hallways, on stairs, and on driveways. Point out anything fragile, recently finished, or already damaged before we start — tight turns, low ceilings, soft flooring and narrow doorways are exactly where problems happen, and knowing in advance is how we avoid them.

If we damage something, tell us before the crew leaves or as soon as you notice, so we can look at it while the facts are fresh. We aren’t responsible for wear that was already there, or for damage that can’t reasonably be avoided when an item physically cannot fit through the space it has to come out of — in which case we’ll stop and talk to you rather than force it.

Safety, and work we’ll decline

We can refuse or stop a job where the site isn’t safe to work, where there’s an unmanaged animal, where a load is beyond what our crew or truck can handle, or where conditions make it unsafe to carry on. Nobody’s judging your garage — this is about not getting anyone hurt.

Photos

We may photograph a load to prepare an estimate and to keep a record of the job. If we ever want to use a photo of your job publicly, we’ll ask you first.

Using this website

Use the site lawfully. Don’t try to break it, get into parts of it that aren’t yours, or put false information into our forms.

Service descriptions, availability and any figures on this site are general and can change. Nothing on this website is a quote.

Disclaimer

This website is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. We don’t warrant that it will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, Junk Magik LLC is not liable for indirect, incidental or consequential damages arising from your use of this website or from services booked through it, including lost items you asked us to remove. Nothing here limits any right you have under law that can’t lawfully be limited, and nothing here limits liability for our own negligence where the law says it can’t be.

Changes

We may update these terms. Changes apply once they’re posted and the “last updated” date above changes with them. The terms that apply to your job are the ones posted when you book it.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute goes to the courts of Alameda County, California.
